ABOUT WORKERS’ COMPENSATION BENEFITS.

We have found three very common misunderstandings regarding workers’ compensation benefits in Pennsylvania after interviewing thousands of injured workers.   

First, your weekly wage benefits never increase. Once the average weekly wage is calculated correctly, you will receive a corresponding weekly wage from the insurance carrier. You will not receive a cost of living increase. 

Second, there is no additional compensation paid for pain and suffering. Workers’ compensation cases are confused with recoveries from motor vehicle accidents or slip and fall injuries. Unlike those accidents, workers’ compensation does not include any payment for pain and suffering.
    
Third, you may not sue your employer. Employers have immunity from suit by injured workers except in very limited circumstances. This has been true since the first Pennsylvania Workers’ Compensation Act was enacted in 1915 and is true today.
